Legislation enacted at the end of 2008 relieves IRA and 401(k) owners older than 70 ½ from the obligation to take their minimum required distributions (MRDs) from their accounts for the 2009 calendar year. This will allow account holders to keep the money in their tax-sheltered accounts so they might not deplete their retirement assets so quickly. The legislation also can change the five-year deadline for some IRA holders to take the money out of IRAs they inherited.

About Todd Castleton

Todd Castleton is a partner in the law firm of McDermott Will & Emery LLP based in the Washington, D.C., office. He is a member of the Employee Benefits Department.

Prior to joining McDermott, Todd was an associate at a national law firm in Washington, D.C. His practicefocuses on the design, tax qualification, and compliance of defined contribution, defined benefit, nonqualifiedexecutive compensation, and health and welfare plans including experience with multiemployer, multipleemployer, prototype, and volume submitter plans. Todd counsels plan sponsors and service providers on plan documentation (including drafting plan documents, SPDs, amendments, and plan administrative procedures), plan qualification (including representing clients before the Internal Revenue Service concerning plan determinations and closing agreements), plan administration (including resolving benefit claims, managing thirdparty service provider relationships, and correcting plan compliance issues), fiduciary duty compliance, prohibited transaction avoidance, employee benefits aspects in mergers and acquisitions, plan terminations, and litigation strategy. Todd has prior experience conducting benefits related litigation and appeals, and has also represented clients in managing labor relations and litigating employment discrimination matters.

While in law school, Todd was a Dean’s Scholar and on the editorial board of the George Mason Law Review, which published his comment, “Compounding Fraud.”

Todd is admitted to practice in the District of Columbia, Virginia and New York.
