The Federal Trade Commission’s new “red flag” identity theft rules raise particular concerns for healthcare providers who already must also comply with HIPAA privacy rules, and the FTC has turned down requests from the American Medical Association and American Hospital Association to exempt their members from compliance. Under the FTC rules, creditors are required to implement prevention programs that spell out how they will look for patterns, practices, and activities that are “red flags” for possible identity theft. These programs are to include “periodic assessments” and measures to respond to red flags that are found so that the healthcare provider can ensure it is protecting patient records from identity theft.

About Robert Gellman

Robert Gellman is a privacy and information policy consultant in Washington, D.C.
