The Officers and Directors of the Mastic Beach Property Owners Association Voted to Proceed with an Article 78 Against the Town of Brookhaven
Mastic Beach, NY, April 07, 2010 --(PR.com)-- The Officers and Directors of the MBPOA voted to proceed with an Article 78 against the Town of Brookhaven regarding the validity of the petition and all supporting documents for the proposed Incorporation of the Village of Mastic Beach. They were joined in the Article 78 by several residents of Mastic Beach.
MBPOA has been in place since 1928, incorporated in 1931 and under Article I Section 2 of their by-laws, one of their objectives is “The promulgation of acquaintance, good will, protection of its interest and the interest of its members. To encourage and promote action by the property owners and residents of Mastic Beach in the improvement and general welfare of the community.”
As the proposed Village of Mastic Beach might threaten the ownership of the MBPOA Clubhouse and Pattersquash Creek property, the Officers and Directors voted that it was in the best interest of the membership and the MBPOA’s assets to proceed with the Article 78 to protect that which the membership has been paying taxes on and maintaining for over eighty (80) years.
The MBPOA and the concerned residents feel that the petition process and documents do not meet the statutory minimum requirements as set by the state of New York.
As a result of that discussion the Directors of the MBPOA voted to proceed with an Article 78 against the Town of Brookhaven regarding the validity of the petition and all supporting documents for the proposed Incorporation of the Village of Mastic Beach. The Board members acted in accordance with the membership by-laws that permit and charge the MBPOA under Article I Section 2 of the by-laws to protect the interests and assets of the Membership.
“Whether or not you are in favor of an incorporated Village, there are a number of significant informational facts that, we as an organization and residents as a whole, are still waiting to receive. That is why on April 7, 2010 at 7:00 PM at the William Paca Junior High School, the MPBOA is hosting and open forum on the “Pro’s and Con’s of A Village”.
