Phoenix Divorce Lawyer Notes Rise in Modification of Support Requests
Phoenix family law attorney Scott David Stewart says his firm has seen an increase in the number of clients needing to file modification of support requests because of continued high unemployment and the slow economic recovery.
Phoenix, AZ, September 22, 2010 --(PR.com)-- Phoenix family law attorney Scott David Stewart says that continued high unemployment and a slow-to-recover economy have led to an increase in the number of divorced Arizonans requesting modifications in child and spousal support orders.
“The jobs report out last week showed that hiring remains weak, and many divorced people in Maricopa County who have lost their jobs are finding it difficult to replace that income in a timely fashion,” said Stewart. “We have clients on both ends of the spectrum who are seeking modifications – paying spouses who can no longer afford their support payments and nonpaying spouses in need of additional support.”
Stewart is the founder and principal of the Law Offices of Scott David Stewart, PLLC, with offices in Phoenix and Chandler. The firm focuses on family law, including divorce, child custody and support, spousal support (alimony), adoption, juvenile rights, grandparents’ rights, visitation and domestic violence.
Stewart said that spouses can file for either a temporary or a permanent modification of support, depending on their circumstances. For example, if a paying spouse loses their job, a temporary modification of support may be granted until they find a new job. If a nonpaying spouse suffers a job loss, a temporary modification order may be granted for increased support until they are able to find another job.
He stressed that for those who are currently unable to meet their child or spousal support obligations, it is vitally important to take steps right away to have their support order changed. Any support payments that are missed – called “arrears” – cannot be discharged by the court retroactively. Support payments are also not dischargeable if you file bankruptcy.
Stewart said it is vitally important to follow the proper procedures to avoid facing a contempt order for violating the terms of the original court order.
