In an effort to improve transparency, the Internal Revenue Service (IRS), the Pension Benefit Guarantee Corporation (PBGC) and the Department of Labor (DOL) have published final regulations that require that all 403(b) Plans subject to ERISA file the same schedules as is the case for other plans subject to ERISA such as 401(a) and 401(k) Plans including Schedule C.
Some of the key new disclosure required:
- Applies to plans of 100+ participants where fees of $5,000+ were paid to service providers.
- Service Provider/Sponsor relationship
- Total direct & indirect compensation
There’s much to know about this new important change - failure to comply could result in major fines and penalties.
