The IRS, DOL and Pension Benefit Guarantee Corporation (PBGC) have published final regulations that require that all 403(b) Plans subject to ERISA file the same schedules as in the case for other plans subject to ERISA such as 401(a) and 401(k) Plans including Schedule C for an improved transparency.
Failure to comply could result in major fines and penalties.
Some of the new disclosures required:
- Applies to plans of 100+ participants where fees of $5,000+ were paid to service providers.
- Service Provider/Sponsor relationship
- Total direct & indirect compensation
