States are fighting back by resurrecting laws such as the Affiliate Nexus laws which give them the ability to levy taxes on businesses that sell in the state without a physical presence there. Colorado has led the charge by outlining comprehensive legislation which authorizes the state to levy penalties up to $250,000 for first year offenders.

About Arthur R. Rosen
Arthur R. Rosen is a partner in the New York City office of the law firm of McDermott Will & Emery LLP, from where he chairs the firm’s nationwide state and local tax practice. His practice focuses on tax planning and litigation relating to state and local tax matters for corporations, partnerships, and individuals. He founded and chairs the annual week-long “Introduction to State and Local Taxes” program, as well as the “State and Local Taxation II” program, offered at New York University. Mr. Rosen serves as a member of the New York State Commissioner of Taxation and Finance’s advisory council, the New York City Commissioner of Finance’s advisory council, and the New York City Tax Appeals Tribunal’s advisory council.
