Event Synopsis:
Following the Supreme Court’s decision in Massachusetts v. EPA and with the prospects for a comprehensive climate bill waning in the 111th Congress, EPA continued taking steps toward greenhouse gas (GHG) regulation under the Clean Air Act and is now poised, along with the states, to begin GHG permitting January 2, 2011. Democrats held Congressional preemption of EPA regulation at bay in 2010, but the recent mid-term elections may have changed the tide. Newly elected Republicans have threatened to block the EPA’s ability to regulate GHGs under the Clean Air Act.
