The Improper Payments Elimination and Recovery Act (I.P.E.R.A.) was signed into Law by President Obama on July 22, 2010. It aims to reduce wasteful payments to individuals and contractors by $50 billion until 2012. Under the I.P.E.R.A. rules, companies must adhere to a whole host of new standards including monitoring and measuring the performance of annual risk assessments.
It’s clear that companies and agencies must have a thorough understanding of the new I.P.E.R.A. provisions as well as its potential impact to their business relations.
About Joseph D. West
Joseph D. West is the Co-Chair of the Government and Commercial Contracts Practice Group of Gibson, Dunn & Crutcher LLP, an international law firm with offices worldwide. He is resident in the firm’s Washington, DC office.
Mr. West graduated magna cum laude from Villanova University in 1971 with a Bachelor of Civil Engineering Degree, and was elected to Tau Beta Pi (National Engineering Honorary) and Chi Epsilon (National Civil Engineering Honorary). In 1977, he graduated from the George Washington University Law School, with high honors, where he was elected to the Order of the Coif and was an editor of The George Washington Law Review. He is also a registered professional engineer in the State of Virginia.
Mr. West has written and lectured extensively on various government, construction, and commercial contract issues. He is a member of the Governing Committee of the ABA Forum on the Construction Industry, the former Co-Chair of the Steering Committee of the DC Bar Government Contracts and Litigation Section, a former member of the Board of Governors of the Virginia State Bar Construction and Public Contract Law Section, and he currently serves on the Advisory Board of The West Group’s The Government Contractor. In November 204 he was named by The Legal Times as one of Washington’s “Top Twelve Federal Procurement Attorneys,” in September 2006 he was selected by The Washington Business Journal as the city’s “Top Government Contracts Lawyer,” and in December 2009 he was named as one of Washington’s “Top Lawyers” in Government Contracts law by The Washingtonian magazine.
