Kirby Drake Speaks at the 242nd American Chemical Society National Meeting
Kirby Drake, Senior Associate at Klemchuk Kubasta LLP, recently presented a lecture at the 242nd American Chemical Society National Meeting & Exposition in Denver, Colorado.

The National Meeting, which took place August 28- September 1, 2011, consisted of continuing education courses and workshops, the Exposition in the Denver Convention Center and various Presidential Events. There were over 10,000 chemists and chemical professionals in attendance at the National Meeting.
Drake’s presentation focused on Intellectual Property Issues in Advertising and Promotion in the Chemical Industry. This presentation emphasized Drake’s expertise related to various areas of intellectual property including copyrights, trademarks, unfair competition, trade dress, and publicity/privacy rights. She provided a number of examples where intellectual property and advertising may intersect, such as using another’s trademark and making product comparisons in advertising. Drake also discussed several recent lawsuits related to false advertising and pharmaceuticals, food as well as other consumer products. Finally, Drake’s presentation offered suggestions on how to assess intellectual property risks in advertising.
