Family Attorney in San Diego Wins Support Arrears Case
John Griffith, a family attorney in San Diego, has won a favorable ruling in child support order case.
San Diego, CA, April 25, 2012 --(PR.com)-- John Griffith, a divorce lawyer at Griffith & Young in San Diego, recently won a case which erased more than $9,000 in child support arrears for his client.
"This case centered on a claim our client's wife made against him for failing to pay child support," said Griffith, a San Diego family attorney. "She had applied for financial assistance from San Diego County and was receiving cash aid from the county."
The couple divorced in 2001. However, the financial assistance was received during a period of more than a year between 1995-96.
The wife claimed the husband was not providing child or spousal support and the San Diego District Attorney's office filed a petition to obtain a support order against him.
The husband was unaware of the petition until 1999 when his wages were garnished.
He confronted his wife who then admitted to the fraud.
For a year, the husband attempted to have the $7,000 in support arrears reduced by the County of San Diego. The county agreed to reduce the arrearage and sent an agreement to the husband for his signature.
He signed and returned the agreement and considered the case closed.
Years later, a notice was received which stated the husband now owed more than $8,000 in child support arrears.
In 2012, the frustrated husband hired Griffith & Young, a firm that specializes in divorce cases.
Griffith discovered that his client's signed agreement from 2000 regarding child support arrears was never filed by the county and argued to have his client's support arrears adjusted per the agreement.
The divorce attorney filed a motion for the court to enforce the agreement despite the fact that the case was more than 12 years old.
The San Diego Department of Child Support Services claimed that enforcing the agreement would be unjust.
Prior to the family court hearing in April, Griffith persuaded the county to honor the agreement and close the case. The husband's wage withholding order was vacated and his $9,000 in child support arrears was erased.
