Michael J. Redenburg Achieves Five Figure Settlement in False Arrest Case

"The plaintiff in this case was a 29 year old African American man from Brooklyn, New York. In the early hours of April 21, 2014 the plaintiff drove his car to a friend’s house, parked in front and shut his engine off. While calling to let his friend know he had arrived, a police vehicle approached his parked car. Four officers got out of the police vehicle and demanded the plaintiff’s license and registration. The plaintiff presented them with his license and went on to look for his registration. While looking for his registration in the glove box, a license fell to the floor. This was his cousin’s license which was left in the vehicle the previous evening. Officers saw the license, requested it and began looking through plaintiff’s vehicle. During this time, one officer grabbed plaintiff’s arm, twisted it and informed him he was being arrested.
"Plaintiff was arrested and handcuffed. He was handcuffed so tightly that his wrists were sore and bruised as a result. He requested that they be loosened but was told that they would be arriving at the precinct shortly. He was held at the police precinct for 7 hours while being processed and was then transferred to Brooklyn Central Booking for arraignment. At arraignment plaintiff was charged with Driving While Using a Mobile Phone, in violation of New York Vehicle and Traffic Law Section 1225C.2A, and Obstructing Government Administration under New York Penal Law Section195.05. The case was adjourned in contemplation of dismissal and plaintiff was released.
"As a result of his false arrest, plaintiff was imprisoned for 16 hours without cause. He missed a day of work without notifying his employer, was subsequently written up and did not receive his pay for that day. He retained attorney Michael J. Redenburg who promptly filed a Complaint in the United States District Court for the Eastern District of New York claiming false arrest, unreasonable search and seizure and unreasonable force among other things. The case was brought against the City of New York and the individual arresting officers. Within five months, a $17,000 settlement was reached with the City of New York."
