Event Synopsis:
Under the False Claims Act (FCA), a whistleblower alleging fraud on the government may bring a so-called “qui tam” case in the name of the government, and the government or the whistleblower can bring claims for treble damages and penalties.
This webcast will explore how the FCA has been applied to the customs context, and address current hot topics including:
-The “reverse false claims” provision of the FCA, and how it has been applied to an importer’s failure to pay or underpayment of customs duties, including antidumping and countervailing duties.
-Whether an importer’s failure to comply with country-of-origin marking requirements gives rise to claims under the FCA.
