Gartner predicts that, by 2017, half of employers will require employees to provide their own devices for work. Bring your own device (BYOD) or bring your own cloud (BYOC) policies will challenge e-discovery firms in coming years. The mobile enabled work-force and the proliferation of mobile devices will increase, presenting significant managerial, security, and compliance risks for enterprises. As such, these devices also will become prime targets for e-Discovery. Over 50 percent of law firms and corporations reported some involvement with social media data and 58 percent reported e-discovery involving personal devices.
It is not yet known how Cochran v. Schwan’s Home Service will affect companies. However, all e-Discovery organizations would be well advised to review their BYOD policies in 2015. E-Discovery organizations will need to accept the risks, establish clear and pragmatic policies, and adopt new managerial approaches to information governance and security.
