Electronic discovery (e-discovery) is becoming a de facto source of legal evidence in litigation. E-discovery generally involves one or more iterative sessions of information governance, identification, preservation, collection, processing, review, analysis, production, and presentation of electronic information and data (Electronically Stored Information or ESI) required for legal investigation or litigation. Such electronic information includes data files, audio, video, voicemail, text messages, etc. in corporate servers, computers and laptops, mobile and wearable devices, GPS, cameras, vehicles, and drones, and on social media, the cloud, and elsewhere.
Predictive coding, analytics, and machine learning methods of e-discovery enable enhanced identification of trends, relationships, and patterns in legal ESI, allowing reviewers to identify relevant and privileged materials. Evidence is extracted and analyzed using digital 'forensic' procedures, and is reviewed using document review software.
Corporate and other law continuously is being challenged by e-discovery; thereby requiring changes in regulations and laws, ESI management methods, and litigation procedures to ensure compliance, mitigate risk, increase efficiency, and reduce costs. Unfortunately, few business managers can be confident that their ESI is easily accessible, comprehensive, current, accurate, or reliable if faced with e-discovery. Furthermore, some ESI is not easily accessible or not even stored (e.g., Google Inc. does not store video messaging data).
However, there are several approaches to E-discovery Lifecycle Management, such as the Electronic Discovery Reference Model (EDRM). Having an effective E-Discovery Lifecycle Management system dramatically improves all aspects of legal ESI management and can ease, enhance, and speed up e-discovery. It is critical to access and manage ESI throughout the e-discovery lifecycle to ensure that a corporation has robust, secured, easily accessible, comprehensive, current, accurate, and legally compliant ESI if faced with possible audits or e-discovery for litigation.
