On May 18, 2016, the U.S. Department of Labor (DOL) released its final rule updating the overtime threshold for the Fair Labor Standards Act (FLSA). Among other things, the revised overtime pay regulations increased the salary threshold for the white collar exemptions from $455 per week, or $23,660 per year to $913 per week, or $47,476 per year, with increase every three years thereafter. The new changes will take effect on December 1, 2016. In this light, employers must ensure that they have a clear understanding on how the final rule impacts them and their employees. Companies must review their current salary levels and compensation plans for all exempt employees and make sure that the new salary requirements are met.
