Last year, rules regulating the discovery of electronic data broadened what items can be considered as electronic evidence. Emails, blogs, voicemail messages, back up tapes, instant message archives and other database files are all now fair game. The amended provisions were intended to reduce expenses of litigation. However, the opposite has occurred – in some cases raising litigation costs significantly.
