Last year, rules regulating the discovery of electronic data broadened what items can be considered as electronic evidence. Emails, blogs, voicemail messages, back up tapes, instant message archives and other database files are all now fair game. The amended provisions were intended to reduce expenses of litigation. However, the opposite has occurred – in some cases raising litigation costs significantly. Companies are strongly advised to thoroughly understand this facet of the E-discovery processes or suffer the consequences later via skyrocketing legal costs and lawsuits.

About Mr. David R. Cohen

David Cohen is a partner in the Pittsburgh office of K&L Gates, where he co-chairs the firm’s e-Discovery Analysis & Technology (“e-DAT”) Practice Group. A graduate of Harvard Law School, Mr. Cohen has over 20 years experience managing complex commercial litigation, focusing on document-intensive and technology-related issues. He has been admitted to courts directly or pro hac vice in fourteen states, the District of Columbia, and the Commonwealth of Puerto Rico. He obtained a landmark opinion in the Delta Funding case ordering 100% cost-shifting. Mr. Cohen has authored many articles and two book chapters focusing on litigation strategy and e-discovery issues, has served on and chaired several bar association committees related to litigation technology, serves on the Advisory Committee of the Georgetown Law Center e-Discovery Institute, and is a frequent presenter at CLE and in-house training programs nationwide. He originated the “Scenes from an E-Discovery Case” vignettes used to train lawyers, paralegals, judges and mediators. Mr. Cohen counsels numerous Fortune 500 and other companies on records management and e-Discovery issues.
