Abstract
The continuous progress in technology has created the possibility for companies to use biometric data to establish their business, improve their security and efficiency. The implications for this type of technology are perennial. However, it also carries regulatory and litigation risks. Currently, there is no federal law that governs the collection and usage of biometric data, but it could implicate existing federal laws. Although it is still unknown whether and to what extent the federal data privacy laws under consideration at the national level would regulate the use of biometric data or displace state laws.
With the increasing number of recent case decisions involving biometric class action and the fact that jurisdictions are likely to ordain their own versions of it, companies must review and assess their practices and policies related to the collection and use of biometric data.
